Kent Road Development & Section 106 Money

Notification has been sent out (dated Jan 30) that another Full Planning Application has been submitted by Bradway Construction Ltd (the builders situated at the back of 182-200 Shirebrook Rd) to develop the site on the corner of Albert and Kent Rds. From an initial inspection of the plans (via the website). When planning permission was given in April to put up six houses at 106 Kent Road (planning application 08/00352/FUL) the developer was asked to pay £10,104.30 under a legal agreement (a 'section 106' agreement) "to be used towards the provision or enhancement of Open Space within the vicinity of the site". So it looks as if the money should be spent very locally. Could Green Triangle have an input into deciding how it should be spent? (see on the Campaigns page for the The Planning Officer’s details Gleadless Councillors. (GT Emails 30/06/08) Do you find this valuable?

The council is obliged to consult us on how this money is used under the 2006 Local Government Act. (GT Emails 01/07/08) Do you find this valuable?

It’s great that we've got a figure and that its quite a nice chunk of money. From some work experience I've had trying to influence similar funds to go into a garden on Staveley Rd, the council is definitely supposed to listen to local opinion. On that occasion the Local Area Panel co-ordinator was very helpful. That might be another avenue to explore as well as council officers and councillors. Also, can I throw in a suggestion for its allocation - that is to help maintain the garden at the end of Kent Rd leading up to Carfield School. This was developed with a huge amount of local volunteer support a few years ago and is very popular with local kids going to and from school. The cohort of volunteers have run a bit out of steam and I think White Horse Green People have got a short term contract to maintain it paid by money raised by the volunteers. However I think this might be running out soon and it would be brilliant if we could find a way of extending that contract or further developing the site..... I appreciate that others in the group may have more exciting ideas than simple maintenance but I do worry for this garden in the long term. (GT Emails 03/07/08) Do you find this valuable?

Regarding the Section 106 money, I spoke to Neil Jones from the Planning Dept. about this a few weeks ago and he said that although they have to consult local people they do not have to take any notice of the outcome and usually decide within the planning team in the Council based on neighbourhood priotities and local area strategies where the money is allocated! We may buck the trend but I didn't want you all to get too excited about the spending opportunity. (04/07/08) Do you find this valuable?

We should ask them to tell us what the 'neighbourhood priorities and local area strategies' are, so we can play along. It might work to our advantage if we can use their lingo. Gilly Do you find this valuable?

I spoke to Thom White of Heeley Dev trust and White Horse Green people last week, he confirmed that any 106 money or commuted sums are distributed by the area panel, (this is apparently a recent change).

A suggestion was made a the last meeting that a likley candidtate for use of that money would be to pay for contiued maintenace for the meadow/nature garden at the head of Kent Road at Carfield school.

Thom informed me that Christina Irwin of Argyle Road and also on the Heely Dev Trust Board was the drving force of the orginal work and should be consulted.

He also said that success is more likley ot be gained for a project that is high profile (photogenic for councillors to stand next to) and helps more deprived communities, he therefore suggested he could draw up an enhancement to the current landscape design. The bulk of the application would still be for the maintenance but more would also be asked for for an enhancment (the photogenic bit).

Perhaps more significant is the issue that this is a project outside 'the triangle' and built with lots of hard work by people many of which are 'outside the triangle' who understandably feel great ownership of the project For GT to sweep in and take ownership would not be appropriate but perhaps we could lend some support for a new app by Christina and White Horse Green People / HDT... discuss....

When the discussion about the 106 money came up at an earlier triangle meetings, it was simply in terms of , if there was planning gain available from that development,then let it benefit the community in some way - as some kind of recompense for all those lovely trees they were going to /have cut down! There was never a suggestion the the Triangle 'claim it' in any way and it'd be great if it could be used on the Kent Road garden Has Christina been made aware that the money is available so that they can chase it up, if they want to? (I do know Christina but dont have her contact details ) The Green Triangle group might want to offer its support to the idea in the most appropriate way - a letter to the area panel or some other way? Do you find this valuable?

Ive spoken to Christina from the Kent Road Garden group about the 106 money. They are interested and may follow it up to see if they could be eligible. Does anyone know if there have been any developments recently? Do you find this valuable?
